Marketplace Terms
Version 1.1. These terms apply to every listing, bid, and Buy It Now purchase on the StreamClash Finance Marketplace from the release of version 1.1.
1. What the Marketplace is
1.1 The Marketplace is the part of the StreamClash Finance portal where staff list in-game items for sale on a StreamClash server (an item is a house or a vehicle), either as a timed auction or at a fixed Buy It Now price. A listing states which it is. A listing cannot be both.
1.2 The Marketplace does not take payment. Winning an auction or using Buy It Now gives you a personal offer. You buy the item only if you then complete checkout: choose to pay in full or in installments, sign the purchase agreement, and make the required payment. The purchase agreement and its schedules then govern the purchase.
1.3 Items are listed only on the server named in the listing. Vehicles may be listed on the MostWanted RP server and the Valley server. Houses are currently listed only on the MostWanted RP server.
1.4 There is no buyer's premium, bidding fee, listing fee, or penalty of any kind for bidders or buyers. The only amounts you can ever pay are those in the offer and agreement you choose to sign.
2. Who can browse, bid, and buy
2.1 Listings are open to signed-in players who hold the supporter role on the listing's server. Signing in with Discord is required to browse, bid or buy.
2.2 To bid or use Buy It Now you must sign in with your own Discord account, be a current member of the Discord guild for the listing's server, and be eligible to enter a purchase agreement under the Portal Terms of Service. You may bid only for yourself.
2.3 Membership is checked when you bid and again when your offer is created. If you are no longer a member when your offer would be created, no offer is created and the listing returns to staff.
2.4 An existing financed agreement does not stop you from bidding, winning, or completing a Marketplace offer. Each agreement is separate.
2.5 StreamClash and its staff do not bid on listings to raise the price.
3. Listing information
3.1 Each listing shows the item, its description and images, its server, whether it is an auction or Buy It Now, the price information in section 4 or section 5, and whether any tax will be added to the price at checkout. Any tax is shown in the offer before you sign.
3.2 The description, images, and the details captured when the listing was created (for a house, such as its name, area, interior type, and garage and storage capacity; for a vehicle, such as its model and name) become part of the agreed specification if you buy. Staff may correct the description and images of a live listing, but not its price terms, end time, or reserve.
3.3 Staff may withdraw a listing at any time before it is sold, including during an auction. If a listing is withdrawn, all bids on it lapse, any offer generated from it is cancelled, and no one is charged anything.
4. Auctions
4.1 An auction has a starting price, a minimum raise, and a fixed end time set by staff. It may also have a hidden reserve price.
4.2 The first bid must be at least the starting price. Every later bid must be at least the current high bid plus the minimum raise. The listing shows the minimum next bid. The minimum applies to the maximum you enter. While you are the high bidder you may only raise your maximum. Two bids of the same amount are not accepted: the first one received stands and the second is refused. You may enter a maximum bid. We then bid for you, one minimum raise at a time, only as much as needed to keep you the high bidder, up to your maximum. A bid placed for you may be less than one minimum raise above the previous bid when it is capped at a maximum. Other bidders do not see your maximum. If two maximums are equal, the one entered first wins. Maximum bids are available only on listings that show the option to set a maximum bid.
4.3 Anti-sniping: if a bid is accepted in the final 2 minutes before the end time, the end time moves to 2 minutes after that bid. This can happen any number of times. Raising your maximum without a new visible bid being placed does not extend the auction. The countdown shown is based on our server's clock.
4.4 Bids are binding on the auction: once accepted, a bid cannot be withdrawn, reduced, or cancelled, and it stays in the ranked bid list. Winning does not itself create a purchase contract or a payment obligation, and letting the resulting offer lapse carries no fee, penalty, or ban (section 6), unless the bid was a purposely fraudulent or troll bid under section 4.8. A maximum bid is binding: it can be raised but not lowered or cancelled, and every bid placed for you under it is a bid you made.
4.5 A reserve price, if set, is not shown. Once any bid has been placed, the listing shows whether the reserve has been met, but not the reserve amount. However, if your maximum meets the reserve, we bid for you up to the reserve: the bid placed for you rises to the reserve, so the current high bid may then equal the reserve. If the auction ends with the high bid below the reserve, there is no winner and the listing returns to staff.
4.6 If the auction ends with no bids, there is no winner and the listing returns to staff.
4.7 If the auction ends with a high bid that meets any reserve, the high bidder wins and receives a personal offer at the amount of their winning bid, with a checkout deadline stated in the offer.
4.8 Fraudulent bidding. Placing bids you never intend to honour, placing bids as a joke or to disrupt an auction (troll bids), bidding to push up the price of an item you sell or are connected to, bidding through another person's account or several accounts, or coordinating bids with others, is fraudulent bidding. Purposely fraudulent bids and troll bids will result in those bids being removed and the accounts involved being permanently banned from all StreamClash servers. Not completing checkout once is not, on its own, fraudulent bidding (section 6.2).
5. Buy It Now
5.1 A Buy It Now listing has a fixed price. The first eligible person to use Buy It Now receives a personal offer at that price, with a checkout deadline stated in the offer. The listing then closes to other buyers. If two people act at the same moment, only one succeeds; the other is told the listing is no longer available.
5.2 Using Buy It Now is subject to section 6 in the same way as winning an auction.
6. After you win or use Buy It Now
6.1 Your offer appears under "Your offers" in the portal, and we notify you by email and attempt a Discord notification. The offer lets you choose to pay in full or, if you are eligible, one of the standard installment plans. You then choose the receiving character, review the full agreement and schedule, and sign.
6.2 If you do not complete checkout by the deadline, the offer lapses. There is no fee, penalty, or ban for letting it lapse, and it does not count against your eligibility for future offers, unless the winning bid was a purposely fraudulent or troll bid under section 4.8.
6.3 If an offer lapses, staff may offer the item to another bidder at that bidder's own highest bid, relist the item, or withdraw it. If you receive such an offer after an auction you did not win, you are under no obligation to accept it; it lapses in the same way if you do not complete checkout.
6.4 The item is delivered to your chosen character automatically (a house is granted to the character; a vehicle is placed in that character's garage on the listing's server) after you sign and the required payment is made, as the purchase agreement describes. The listing shows as sold once payment is made.
7. Who can see what
7.1 The listing shows the current high bid, the number of bids, whether the reserve has been met once any bid exists, the end time, and, after the listing ends, whether it sold and the final price. It never shows who placed a bid or the reserve amount.
7.2 When you are signed in, you can see whether you are the current high bidder or have been outbid, and a list of your own bids.
7.3 Staff can see the full ranked list of bids with the identity of each bidder, and each bidder's maximum. They use it to run the Marketplace, to make offers under section 6.3, and to investigate misuse. The Privacy and Evidence Policy explains how bid records are kept.
8. Notifications
8.1 We send notifications by email and attempt them by Discord DM when you are outbid (that is, when you lose the lead; if your maximum is already beaten as you enter it, the listing page shows this instead), when you win an auction, when your Buy It Now is confirmed, before your offer's checkout deadline, when your offer lapses, and when staff make you an offer at your own bid. Email is the formal channel; a failed Discord DM does not change your rights or obligations.
9. Errors, misuse, and outages
9.1 If a listing contains an obvious error in its price terms, staff may withdraw it before an offer is signed. We do not charge anyone because of an error.
9.2 Bids placed through a compromised account, for someone else, or to manipulate a listing may be removed from the ranking, and the account may lose access to the Marketplace, after a review under the Server Enforcement and Digital Entitlement Policy. Where the bidding is fraudulent bidding under section 4.8, the accounts involved may also be permanently banned from all StreamClash servers. Removing a bid does not create any charge.
9.3 If the portal is unavailable near the end of an auction, the auction still ends at its end time as extended under section 4.3. We do not promise that every bid attempt reaches us. We record the bids we actually accept, with their times.
10. Your rights
10.1 Nothing in these terms removes a right you have under the law where you live. Winning a listing does not remove any cancellation or withdrawal right that applies to the purchase agreement you later sign; Schedule B of that agreement sets out the rights we grant.
10.2 Contact [email protected] with the listing number about any problem with a listing, a bid, or an offer.
